Terms of Service: AI Image Generator User Agreement

Introduction

Welcome to Z-Image AI (https://z-image-ai.run/), an AI-powered image generation platform. These Terms of Service ("Terms") are a legally binding agreement between you and Z-Image AI. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Description of Service

Z-Image AI provides a unified interface for AI image generation using third-party AI models. Through the Service, you can:

• Generate images from text prompts (text-to-image)
• Transform reference images using AI (image-to-image)
• Choose between multiple AI models with different strengths
• Pay through a credit-based system (one-time purchases or subscriptions)
• Save and download your generated images

We may modify, suspend, or discontinue parts of the Service at any time, with or without notice.

2. Eligibility and Accounts

2.1 Age Requirement

You must be at least 13 years of age (or the age of digital consent in your jurisdiction, whichever is higher) to use Z-Image AI. By using the Service, you represent that you meet this requirement and are legally capable of entering into binding agreements.

2.2 Account Creation

To use most features, you must create an account. You agree to:

• Provide accurate, current, and complete information at registration
• Maintain the security and confidentiality of your credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access at support@z-image-ai.run

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

3. Acceptable Use Policy

3.1 Permitted Uses

You may use Z-Image AI for any lawful purpose, including personal creativity, professional design work, commercial projects, education, and research.

3.2 Prohibited Activities

You agree NOT to use the Service to:

• Generate child sexual abuse material (CSAM) or any content sexualizing minors
• Generate non-consensual sexual imagery, including images of identifiable real people in sexual contexts without their consent
• Create deepfakes or impersonations of real individuals intended to deceive, defame, or harass
• Generate content that promotes violence, terrorism, self-harm, or discrimination based on protected characteristics (race, ethnicity, religion, gender, sexual orientation, disability, etc.)
• Produce content that infringes copyright, trademark, publicity, or privacy rights of others
• Bypass or attempt to bypass our content safety systems, rate limits, or billing
• Scrape, automate, or abuse the Service via bots without prior written consent
• Reverse-engineer, decompile, or attempt to extract our proprietary code or infrastructure
• Use the Service to engage in or facilitate any illegal activity

Violation of this section may result in immediate account suspension, deletion of generated content, forfeiture of credits, and reporting to law enforcement where applicable.

4. Content Restrictions and Moderation

4.1 Restricted Content

You may not generate, upload, or distribute content that:

• Contains sexually explicit material, nudity, or pornography
• Depicts graphic violence, gore, torture, or self-harm
• Contains hate speech, extremist ideology, or content promoting terrorism
• Encourages illegal or dangerous activities
• Infringes copyright, trademarks, or publicity rights
• Falsely represents affiliation with or endorsement by Z-Image AI

4.2 How We Moderate

We employ automated content moderation on both the prompt input (text profanity / dictionary filtering) and the generated image output (via the AI providers' built-in safety checkers). Generations flagged as policy-violating are blocked, and the corresponding credits are automatically refunded to your account.

We also reserve the right to manually review accounts that show patterns of policy-violating attempts and to suspend such accounts without prior notice.

5. Generated Content Ownership

5.1 Your Rights to Generated Images

Subject to compliance with these Terms, you own the images you generate through Z-Image AI and may use them for personal, creative, or commercial purposes. We do not claim copyright over the output of generations you submit.

5.2 AI-Generated Content Caveat

Important note about copyright protection of AI-generated images: In many jurisdictions, notably the United States (per the U.S. Copyright Office), purely AI-generated works without significant human creative input may not qualify for traditional copyright protection. Z-Image AI does not provide legal advice on this matter. Consult a qualified attorney for high-stakes commercial use.

5.3 Z-Image AI's Property

We own:

• The Z-Image AI website, user interface, code, and infrastructure
• The "Z-Image AI" brand, name, logo, and visual identity
• All marketing copy, documentation, and templates we produce

5.4 Third-Party AI Models

The underlying AI models used by the Service (including but not limited to Z-Image, Nano Banana 2, GPT Image 2, and Seedream 4.5) are owned by their respective developers (Alibaba, Google, OpenAI, ByteDance, etc.) and provided via the fal.ai API. We do not own or control these models, their weights, or their training data. Your use of these models through our Service is also subject to their respective providers' usage policies where applicable.

6. Privacy and Data

6.1 No AI Training on Your Data

Z-Image AI does not train any AI model. We call third-party AI APIs. We do not provide your prompts, images, or any user data to any party for AI training purposes.

6.2 Data Storage

We store your prompts, generated images, and reference images to provide history, support, and abuse-prevention features. For full details (including what we store, why, retention periods, and your rights), see our Privacy Policy.

7. Payment, Credits, and Subscriptions

7.1 Credit-Based System

Z-Image AI uses a credit-based pricing system:

• Credits are consumed when you generate images
• Different models, resolutions, and quality levels cost different amounts of credits, displayed before generation
• You can purchase credits as one-time packages or subscribe to monthly/yearly plans

Current pricing is shown on the Pricing page. We may adjust prices with at least 30 days' notice to existing subscribers.

7.2 Payment Processing

• All payments are processed by our payment provider, Creem
• We do not receive or store your card details; Creem handles them
• You authorize Creem to charge your selected payment method for purchases and subscription renewals

7.3 Subscription Auto-Renewal

Important, please read carefully:

• Monthly and yearly subscriptions automatically renew at the end of each billing period until canceled
• Renewal charges the same payment method used at sign-up
• You will receive an email receipt after each renewal
• We may notify you by email before annual renewals occur

7.4 How to Cancel a Subscription

You can cancel at any time using either of these methods:

1. From your account dashboard: visit Settings → Billing and click "Manage Subscription" or "Cancel Subscription"
2. Email support@z-image-ai.run with your subscription details

Cancellation takes effect at the end of the current billing period. You retain access to credits granted in that period until expiration as defined for your plan.

7.5 Refunds

Refunds may be issued in the following situations:

• Duplicate payments or system errors that result in undelivered credits
• Failed generations due to platform issues (these are automatically refunded to your credit balance)
• Discretionary refunds for goodwill: email support@z-image-ai.run with your order details and reason

Refund decisions are made case-by-case. Used credits and credits granted in periods you have already used are generally non-refundable.

When a refund is issued, the credits granted by that order are reclaimed from your account (any unspent portion is voided; already-spent portion stays as your prior use of the service).

7.6 No Refund for Policy-Violating Requests

Credits spent on prompts or uploads that violate our Acceptable Use Policy, including but not limited to attempts to generate sexually explicit, NSFW, CSAM, non-consensual sexual imagery, deepfakes, hate speech, or other prohibited content as defined in Section 3, are not eligible for refund, regardless of whether the generation was successfully completed, blocked by our content moderation, or rejected by an upstream AI provider.

This includes credits consumed when:

• A prompt is rejected by our pre-generation moderation pipeline for policy violations
• An output is blocked by an upstream AI provider's safety filter due to prohibited content in the prompt
• Multiple attempts are made to circumvent content filtering through rephrasing, character substitution, or other prompt-engineering techniques

Repeated policy-violating attempts may also result in account suspension or termination without refund of any unused credit balance, as outlined in Section 11.

8. Service Availability and Disclaimers

8.1 No Uptime Guarantee

While we strive for reliable service, we do not guarantee that the Service will be uninterrupted, error-free, or available at any specific time. Maintenance windows, third-party AI provider outages, and unexpected issues may cause temporary interruptions.

8.2 AI-Generated Content Disclaimer

AI-generated images may:

• Contain visual artifacts, inaccuracies, or biases reflective of the training data of the underlying models
• Produce results that differ from your intent or expectation
• Vary in quality and style between generations, even with the same prompt

You are solely responsible for reviewing, verifying, and choosing how to use any generated content. We make no warranty as to accuracy, suitability for any specific purpose, or non-infringement of third-party rights of the outputs.

8.3 As-Is Service

To the maximum extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Z-Image AI be liable for:

• Indirect, incidental, special, consequential, punitive, or exemplary damages
• Lost profits, lost revenue, lost data, or lost business opportunities
• Damages arising from content you generate or distribute using the Service
• Damages arising from service interruptions or unavailability
• Damages caused by the actions of any third party (including AI model providers, payment processors, and other users)

Our total cumulative liability to you for all claims arising out of or related to the Service shall not exceed the total amount you paid us in the 12 months preceding the event giving rise to the claim, or USD $100, whichever is greater.

Some jurisdictions do not allow exclusion of certain damages. To the extent prohibited by law, the exclusions and limitations above may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Z-Image AI, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms or any applicable law
• Your violation of the rights of any third party (including intellectual property, privacy, or publicity rights)
• Content you generate, upload, distribute, or share

11. Termination

11.1 Termination by You

• You may stop using the Service at any time.
• You can cancel subscriptions from Settings → Billing without contacting us.
• To delete your account entirely (which removes your data per our Privacy Policy), email support@z-image-ai.run with the request from your registered account email.

11.2 Termination by Us

We may suspend or terminate your access if:

• You violate these Terms or our content policies
• You engage in fraudulent, abusive, or illegal activity
• You attempt to bypass safety systems, rate limits, or billing
• Required for legal, regulatory, or platform-integrity reasons
• Your account is inactive for an extended period

We will normally provide notice before termination, except in cases of fraud, security threats, or where notice would itself enable further violation.

11.3 Effect of Termination

Upon termination:

• Your right to access the Service immediately ceases
• Generated content stored under your account may be deleted (subject to legal retention requirements)
• Unused subscription credits granted in the current billing period are generally forfeited unless the termination was caused by our error
• The provisions of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and dispute resolution) remain in effect

12. Copyright Claims (DMCA Notice)

If you believe content generated or hosted on Z-Image AI infringes your copyright, you may send a written notice to support@z-image-ai.run including:

1. Your physical or electronic signature
2. Identification of the copyrighted work claimed to be infringed
3. Identification of the material claimed to be infringing and its location on our Service
4. Your contact information (address, phone, email)
5. A good-faith statement that the use is not authorized by the copyright owner, agent, or law
6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf

We will respond to valid notices and may remove the allegedly infringing content. Repeat infringers' accounts will be terminated.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with applicable laws of the jurisdiction in which Z-Image AI is operated, without regard to conflict-of-law principles.

Any disputes will be resolved through:

1. Informal negotiation: Contact us first at support@z-image-ai.run to attempt resolution
2. Formal resolution: If informal negotiation fails after 30 days, disputes shall be resolved through binding arbitration or litigation as determined by applicable law

To the extent applicable law (e.g., EU consumer protection law) provides you with rights that cannot be waived, those rights remain in effect.

14. Modifications to These Terms

We may modify these Terms from time to time. When we do:

• Material changes (affecting your rights or obligations) will be communicated by email to registered users at least 14 days before taking effect
• Non-material updates are posted on this page with a new "Last Updated" date
• Your continued use of the Service after the effective date constitutes acceptance of the modified Terms
• If you do not agree to a material change, you may close your account before it takes effect and request a refund of any unused subscription credits per Section 7.5

16. Severability

If any provision of these Terms is found unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
